In this privacy policy (“Policy”), “Sigsense”, “we” or “us” refers to Sigsense Technologies, Inc., a Delaware company with its address located at 350 Townsend St. Suite 100, San Francisco, California 94107 US. We are the data controller under the applicable privacy laws. Where we have an arrangement in place with a customer who is encouraging you to use our Services (for example, your employer), we in some circumstances obtain and process your Personal Information on behalf of and at the instructions of such a customer. Such customers are the data controllers and their privacy policies will apply to the processing of your Information. We encourage you to read their privacy policies.

This Policy informs you of our practices when we handle your Personal Information when you access our website at http://www.sigsensetech.com/, https://www.sigsense.tech/ or any dedicated Sigsense website that links to this Policy (“Website”) and use our asset management service (together with the Website, the “Services”). For the purpose of this Policy, “Personal Information” means any information related to an identified or identifiable individual. This includes Personal Information you provide or generate when you access and use our Services.

When you use the Services, you accept and understand we collect, process, use and store your Personal Information as described in this Policy. If you do not agree with this Policy, you must not use the Services. If you change your mind in the future, you must stop using the Services and you may exercise your rights in relation to your Personal Information as set out in this Policy.

  1.       INFORMATION WE COLLECT
  2. We collect the following categories of Personal Information from you from the following sources:

    • Information you provide to us
      • Registration information, for example, when you create an account on our Website, you provide us with your name, address, email, password and phone number. If you are an admin user, you also provide the name, email and phone number of other users when you add them to the company account. Note that other users of a company account may see these details.

        Please make sure you have obtained authorization or permission from other users before sharing Personal Information relating to them with us.

      • Communication information, for example, when you contact us on our Website through our contact form, via email or otherwise, you provide us with your name, email address, the phone number, contents of your communication and any other information you choose to provide to us as part of your communication.

      • Support Information, for example, when you request technical support services, we will process your Personal Information such as your name and the contact details you use to contact us, as well as information on the reasons for your support request, and any additional information you may provide in that context.

    • Information we automatically collect or is generated about you when use the Services
      • Identifiers, when you use the Services, your IP address, device information, browser information, other unique identifiers, information collected by cookies on your usage of the Services and potentially non-personal information about your device are automatically collected either by us or third parties.       • Information regarding your use of the Services, such as website usage information and metadata are automatically collected either by us or third parties.

    • Information received from third parties.
      • Information from platforms our Services rely on, such as Squarespace, who host the Website, and provide us with analytics about use of our Website, and customer enquiries.

    We also collect, use and share aggregated data such as statistical or demographic data for our purposes. Aggregated data may be derived from your Personal Information but is not Personal Information as this data will not directly or indirectly reveal your identity. However, if we combine or connect aggregated data with your Personal Information so that it can directly or indirectly identify you, we will treat the combined data as Personal Information which will be used in accordance with this Policy.

    • Provide you with the Services. We will use your registration information in order for you to create an account.

    • Improve and monitor the Services. We use your identifiers and device information, cookies and information regarding your use of the Services (such as metadata) to improve our Services for our users. We train our proprietary artificial intelligence technology on aggregated data that does not identify you or other users.

    • Communicate with you and provide support. We use your communication information to contact you (e.g. when you request information , have a question or otherwise contact us) to provide you with your requested information, respond to your comments, answer your questions or to send you marketing communications, such as updates on events relating to products and services offered by us.

    • Conduct analytics. We will process relevant information we automatically collect or is generated about you (such as your identifiers, device information, and browser information) to create anonymized and aggregated data regarding your use of the Services in order to analyze the use of, and any other interaction or interest in, our Services.

    • Send you marketing communications. We use your communication information, relevant identifiers and device information (such as your device information) and information regarding your use of the Services to send you marketing communications. You may opt out of such communications by contacting us at support@sigsensetech.com.

    • Show you advertising outside of our Services. We may use your Personal Information to show you advertising for our Services outside of our Services. Such information includes your identifiers and usage information. Please see our Cookie Policy for further information.

    • Prevent fraud, defend Sigsense against legal claims or disputes, enforce our terms and to comply with our legal obligations. We protect our interests through (1) monitoring the use of the Services to detect fraud or any other user behavior which prejudices the integrity of our Services, (2) taking steps to remedy aforementioned fraud and behavior, (3) defending ourselves against legal claims or disputes, and (4) enforcing our terms and policies. When doing so, we will process the Personal Information relevant in such a case which includes information you provide us, information we automatically collect about you, and information which is provided to us by third parties.

  5.       LEGAL BASIS FOR THE PROCESSING OF PERSONAL INFORMATION

    • Consent. We obtain your consent for the use of your Personal Information, for example, to send you electronic marketing communications or for the use of certain cookies.

    • Vendors and service providers we rely on for the functioning of our Services, for example:

      • Sendgrid (Twilio), who we rely on to send emails to you and other users.

      • Zendesk, who we rely on for the functioning of our support center.

      • Google Analytics, who we rely on for analytics of our service use.

      • Squarespace, who we rely on to host our marketing site.

      • Twilio, who we rely on to send SMS notifications to users for equipment alerts.

      • Mailchimp, who we rely on to send marketing campaign emails.

      Our vendors and service providers are based in the U.S.

    • Companies who belong to the same group as Sigsense. We share your Personal Information with entities in the group we belong to in order to provide the Services.

    • Law enforcement agencies, public authorities or other judicial bodies and organizations. We disclose Personal Information if we are legally required to do so, or if we have a good faith belief that such use is reasonably necessary to comply with a legal obligation, process or request; to enforce an agreement, terms of service, policies, and standards, including investigation of any potential violation thereof; detect, prevent or otherwise address security, fraud or technical issues; or protect the rights, property or safety of us, our users, a third party or the public as required or permitted by law (including exchanging information with other companies and organizations for the purposes of fraud protection).

    • Subsequent corporate ownership. If we are involved in a merger, acquisition, bankruptcy, reorganization, partnership, asset sale or other transaction, we may disclose your Personal Information as part of that transaction.

  9.       HOW LONG WE STORE YOUR INFORMATION
  10. Your Personal Information is kept for as long as necessary to achieve the purposes set out above. Some information we collect will be stored for longer where we have an overriding legitimate interest to retain such information (for example, information on suspicious behavior of certain users of our Services and transaction records).

    When deleting Personal Information, we will take measures to make the Personal Information irrecoverable or irreproducible, and electronic files which contain Personal Information will be deleted permanently.

    • Erasure. You have the right to request for your Personal Information to be erased or deleted.

    • Object to processing. You have the right to object to our processing of your Personal Information where we are relying on a legitimate interest.

    • Restrict processing. You have a right in certain circumstances to stop us processing your Personal Information other than for storage purposes.

    • Portability. You have the right to receive, in a structured, commonly used and machine-readable format, Personal Information that you have provided to us if we process it on the basis of our contract with you, or with your consent, or to request that we transfer such Personal Information to a third party.

    • Withdraw consent. You have the right to withdraw any consent you previously applied to us. We will apply your preferences going forward, and this will not affect the lawfulness of processing before your consent was given.

    You may access and, depending on your authorization level, correct or erase your Personal Information through your account settings.

    Please note that, prior to any response regarding the further exercise of your rights, we will require you to verify your identify. In addition, we may require additional information (for example, why you believe the information we hold about you is inaccurate or incomplete) and may have valid legal reasons to refuse your request.   13.       INTERNATIONAL DATA TRANSFERS

If you are located in Europe, we may transfer your Personal Data outside of the European Economic Area and, in particular, to the US, where the level of protection of Personal Data may be different than in your country. If we do so, we will comply with applicable data protection laws.   16. We use certain physical, managerial, and technical safeguards that are designed to improve the integrity and security of the Personal Information that we collect and maintain. However, the transfer of Personal Information through the internet will carry its own inherent risks and we do not guarantee the security of your data transmitted through the internet. You make any such transfer at your own risk.

    The Website provides links and plug-ins to websites operated by third parties. Any information you provide to third party websites is provided directly to the operators of such websites and subject to their policies governing privacy and security, even if accessed via our Website. We are not responsible for the content, privacy and security practices and policies of such third parties.
